“Mickey’s Magical Halloween Hunt” – A Character Dining Experience - Terms & Conditions

The organizer of Hong Kong Disneyland’s “Mickey's Magical Halloween Hunt” - A Character Dining Experience (“Dining Experience”) to be held at Explorer’s Club Restaurant in the Hong Kong Disneyland Park (“Park”) is Hongkong International Theme Parks Limited at Hong Kong Disneyland Resort, Lantau Island, Hong Kong (“HKITP”).

In these Terms and Conditions, each person submitting a reservation for the Dining Experience is referred to as “Registrant”; each guest of the Registrant for whom a Reservation is submitted is referred to as “Guest”; and the Registrants and the Guests are collectively referred to as “Participants”.

 
  1. All Participants warrant that they have read these Terms and Conditions carefully. By participating in the Dining Experience, each Participant signals his/her complete acceptance and full understanding of these Terms and Conditions.
  2. In the event of any dispute regarding these Terms and Conditions and all other matters relating to the Dining Experience, the decision of HKITP shall be final. HKITP’s interpretation of these Terms and Conditions shall be final and conclusive.
  3. Subject to availability, the Dining Experience is available on a first-come, first-served basis on September 15 and 16, and October 20, 21, 27 and 28, 2017 in the following dining sessions:
    1. First Seating: from 5:45 p.m. to 7:30 p.m. and
    2. Second Seating: from 8:00 p.m. to 9:45p.m.
  4. The Dining Experience is available at the following regular price:
    1. HK$398 per adult; and
    2. HK$199 per child aged 3 to 11
  5. Registrants may enjoy the Dining Experience with up to 7 Guests at an early bird discount of 25% off if:
    1. the Registrant makes a successful reservation for him/herself and his/her Guests for one dining session with full payment made prior to the chosen dining date; and
    2. full payment for the reservation is made at least 5 days prior to the chosen dining date.
  6. Registrants may enjoy the Dining Experience with up to 7 Guests at the regular price if the Eligible Registrant makes a successful reservation for him/herself Guests for one dining session with full payment made less than 5 days prior to the chosen dining date.
  7. A 10% service charge based on the regular price will be charged for all Dining Experience, whether or not an early bird discount is applied.
  8. The Dining Experience cannot be used in conjunction with other food and beverage promotions or discounts, including but not limited to the Magic Access Member Park Dining Offer and Birthday Privileges.
    Eligible Registrations
  9. To be eligible for the Dining Experience, the Registrant must:
    1. hold a valid Magic Access Membership Card of any tier during the period from (and including) the date of reservation to (and including) the chosen dining date; and
    2. has the Magic Access membership or a valid admission ticket to be admitted to the Hong Kong Disneyland Park (“Park”) to participate in the Dining Experience on the chosen dining date; and
    3. be successfully registered for the Dining Experience with full payment made for his/her participation in the Dining Experience in accordance with these Terms and Conditions.
  10. The Dining Experience does not include admission to the Park.
  11. Participants aged below 16 must be accompanied by another Participant aged 16 or above throughout the Dining Experience.
  12. HKITP reserves the right to verify the eligibility of all Participants and to disqualify any Participant if HKITP has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
    Reservation and Payment
  13. To be eligible to submit a Reservation, the Registrant must be aged 13 or above. Reservation for Participants aged between 10 to 13 years old must be submitted by his/her parents or legal guardian on the Participant’s behalf. HKITP reserves the right to verify the eligibility of any Registrant.
  14. Registrants may register for the Dining Experience (a) at www.hongkongdisneyland.com/magic-access-members and submitting the requested information, or (b) by calling +852 3550 3388. Upon submitting reservation by one of these methods and providing contact information, HKITP will contact Registrants within a reasonable time to provide payment instructions. To successfully make a Dining Experience reservation, full payment must be made in accordance with HKITP’s instructions and HKITP must receive full payment prior to the chosen dining date.
  15. Registrants are advised to allow sufficient time for completing the reservation process and HKITP is not responsible for any delay.
  16. Registrants must not register for any Guest or submit information of such Guest without their consent. Registrant shall obtain, and HKITP is not responsible for obtaining the Guest’s consent.
  17. Each Participant may register or allow himself / herself be registered for the Dining Experience once for each chosen dining date and session. Each Registrant may register in the Dining Experience for himself / herself and together with a maximum of 7 Guests.
  18. All times and dates stated in these Terms and Conditions are Hong Kong time. HKITP reserves the right to disqualify any late, misdirected, incomplete, corrupted, lost, illegible or invalid reservations.
  19. If the Registrant does not attend the Dining Experience (as a result of reasons described in paragraphs 19 to 21 below, or for any other reason) HKITP may disqualify the Guest in the same reservation submitted by such Registrant without refund or compensation. Subject to paragraph 11 above, Registrants can attend the Dining Experience without his/her Guest.
  20. If a Registrant decides to change the chosen dining date or session, he/she needs to cancel the original reservation first and re-register for a new dining date or session, subject to availability. Once the reservation is cancelled, it cannot be retrieved or resumed. Payment made for the cancelled reservation may be forfeited by HKITP without refund or compensation.
  21. Confirmation will be given to successfully registered Registrant during reservation after full payment is made for each Participants named in the reservation.
  22. If any Registrant (a) fails to complete the full payment, (b) fails to receive the notice as a result of his/her failure to provide his/her correct contact information, (b) does not attend the Dining Experience, or (c) fails to comply with these Terms and Conditions or the terms and conditions in the notice, payment made for the reservation may be forfeited by HKITP without refund or compensation.
  23. Neither HKITP nor any of its affiliates shall be responsible for any failure to notify any Participants, whether such failure is caused by HKITP’s or any of its affiliates’ negligence or otherwise.
  24. There is quota for the Dining Experience. Registration is on a first come first serve basis and is subject to availability.
  25. HKITP reserves the right to reject or disqualify any late, misdirected, incomplete, corrupted, lost, illegible or invalid reservations.
  26. The Dining Experience is non-transferrable, non-refundable and non-exchangeable. No change and cancellation can be made once the reservation is successfully made.
    Redemption of the Dining Experience
  27. Participants shall arrive at the designated gathering point at Explorer’s Club Restaurant podium at the start time on the chosen dining date and session. Participants who arrive late will not be able to enjoy the complete Dining Experience and will not be entitled to any compensation or refund. Requests to change the time and duration of the Dining Experience will not be accepted.
  28. The Registrant must accompany his/her Guests at all times throughout the Dining Experience.
  29. Registrants are required to present the confirmation issued by HKITP, their valid Magic Access Membership Cards and such personal identification as HKITP may require for verification purposes. HKITP may refuse admission to the Dining Experience if the confirmation or the valid Magic Access Membership Card are not presented by the relevant Registrant in person.
  30. The identity of the Participants must remain the same throughout the Dining Experience and no change in any Guests is allowed once the reservation is made.
  31. The Dining Experience is available in Cantonese only.
  32. The Dining Experience may be delayed or cancelled due to inclement weather without prior notice and compensation. For inclement weather arrangement, please visit www.hongkongdisneyland.com.
    Other Terms
  33. Admission to the Park is subject to the Rules and Regulations of the Park which are set out in the website at www.hongkongdisneyland.com. HKITP may from time to time, without prior notice and without refund or compensation, change the operating hours of the Park or attractions, close the Park or any part of it temporarily, restrict the number of persons having access to the Park, and/or suspend or cancel any attraction or entertainment program, due to capacity, inclement weather, special events, to ensure safety, security or order, or if HKITP considers that the circumstances so require.
  34. All expenses not specifically provided for in these Terms and Conditions including but not limited to transportation to the Park, admission tickets, food and beverages, gratuities, insurance, parking, room service, merchandise, service charges and telephone calls, are the Participant’s sole responsibility.
    Liabilities
  35. Each Participant fully indemnifies HKITP, its affiliates, and the directors, officers or employees of each, against all actions, losses, claims, damages, costs and expenses of whatever nature arising directly or indirectly from any breach of any representation or warranty or any Terms or Conditions contained herein.
  36. To the maximum extent permitted by applicable law, HKITP shall not be liable to any person for any loss or damage (whether caused by the negligence of HKITP or otherwise) or any personal injury or death arising (whether directly or indirectly) from or in connection with the Dining Experience including, but not limited to, loss of income, profits or goodwill, any loss or damage arising from any failure to receive or process any reservation; any computer, telecommunications or equipment failure or malfunction; any deficiency or inadequacy of service rendered by any third party; or any notice which is misdirected or lost in the postal system even if HKITP has been advised of the possibility of such loss or damage.
    Miscellaneous
  37. By submitting or agreeing to the submission of a reservation for the Dining Experience, each Registrant represents that he/she has read and understood and agrees to comply with, and procure his/her Guest to comply with, these Terms and Conditions.
  38. HKITP reserves the right to disqualify any reservation or any Participant or his/her participation in the Dining Experience if HKITP has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
  39. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“HKSAR”).
  40. The Dining Experience is organized in accordance with the laws of the HKSAR only. Those who choose to participate in the Dining Experience do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.
  41. In the event of any dispute regarding these Terms and Conditions and all other matters relating to a reservation or the Dining Experience, the decision of HKITP shall be final. HKITP’s interpretation of these Terms and Conditions shall be final and conclusive.
  42. In the event any conflict arises between the English version and any version in any other language into which these Terms and Conditions have been translated, the English language version shall prevail.
  43. These Terms and Conditions constitute an agreement between HKITP and each Participant respectively. A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce any term of this agreement.


Personal Information Collection Statement

All personal data collected in connection with the Dining Experience may be used for all purposes in connection with the Dining Experience including, without limitation, the processing of the Participants’ enquiries regarding Participants’ participation in the Dining Experience and any arrangement in connection with the Dining Experience; enforcing the terms of the commercial dealings; sending administrative materials to Participants; our internal business and administrative purposes, research and statistical purposes or other directly related purpose, or for legal, safety or security purposes. Provision of personal data for the mandatory fields is necessary. If a Participant does not provide such personal data, we may not be able to provide Participant with the products or services requested. Personal data may be transferred to third parties involved in fulfilling the aforesaid purposes, or such other persons as required by law. A list of classes of persons to whom such personal data may be transferred can be found at www.hongkongdisneyland.com/personal-data-transferees. By participating in the Dining Experience, each Participant consents to the use and transfer of Participant’s personal data set out in this statement.
