Magic Access Member "Ant-Man and The Wasp: Nano Battle!" Preview Terms & Conditions

The organizer of Hong Kong Disneyland's Magic Access Member "Ant-Man and The Wasp: Nano Battle!" Preview ("Special Event") to be held at the Hong Kong Disneyland Park ("Park") is Hongkong International Theme Parks Limited at Hong Kong Disneyland Resort, Lantau Island, Hong Kong ("HKITP").

In these Terms and Conditions, each person submitting a registration for the Special Event is referred to as "Registrant"; each guest of the Registrant for whom a Registration is submitted is referred to as "Guest"; and the Registrants and the Guests are collectively referred to as "Participants".
Participants
  1. To be eligible for the Special Event, the Magic Access member registering for the Special Event must be a holder of a valid Magic Access Membership Card (of any tiers including platinum, gold and silver) during the period from (and including) the date of registration to (and including) the day on which the Special Event Session is held.
  2. To be eligible to register for the Special Event, the Participant must be aged 13 or above and for Participant aged below 13, he/she would require his/her parents or guardian to register the Special Event on behalf of the Participant.
  3. HKITP reserves the right to verify the eligibility of all Participants. HKITP reserves the right to disqualify any Participant if HKITP has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
    Preview Sessions
  4. Subject to these Terms and Conditions, each Participant may register for one reserved space in the Magic Access Member "Ant-Man and The Wasp: Nano Battle!" Preview in one of the sessions ("Preview Session") as HKITP may make available to the Participants for registration.
  5. Throughout the Preview Session, each Participant aged below 16 must be accompanied by another Participant aged 16 or above who has successfully registered for the same Preview Session. Each attraction vehicle accommodates up to 2 adults and 1 child.
    Eligible Registrations
  6. Registrants may register for the Special Event by visiting https://www.hongkongdisneyland.com/magic-access-members/ ("Site") and submit the requested information in accordance with the instructions therein. Registrants must not register for any Guest (as defined below) or submit information of such Guest without their consent. Registrant shall obtain, and HKITP is not responsible for obtaining the Guest's consent.
  7. Each Registrant may register for the Special Event only once, for himself / herself and together with a maximum of two participants who each hold a valid Magic Access membership card during the period from (and including) the date of registration to (and including) the day on which the Special Event will be held. Single participant is also eligible for registration as Registrant.
  8. If the Registrant does not attend the Preview Session (as a result of reasons described in paragraphs 11, 12 or 13 below, or for any other reason) HKITP may disqualify the Guest in the same registration submitted by such Registrant from the Special Event. Registrants can attend the Preview Session without the Guest.
  9. Registration is on a first come first served basis and is subject to availability.
  10. For each Participant or Registrant aged below 18, a true and accurate e-mail address of such person's parent or guardian (as the case may be) must be submitted. HKITP will send an e-mail to such e-mail address confirming the parent's or guardian's permission for the relevant registration in the Special Event. HKITP reserves the right to disqualify any Participant or Registrant from the Special Event if objection from his/her parent or guardian is received.
  11. Registration for the Special Event (including any change of information submitted in the registration) must be completed on or before 23:59 (Hong Kong time) 2 calendar of the days prior to the scheduled Preview Session. HKITP reserves the right to disqualify any late, misdirected, incomplete, corrupted, lost, illegible or invalid registrations.
  12. Notice will be sent to each Registrant to the email address provided during registration on the Site. If any Registrant or his/her Guest (a) fails to receive the notice as a result of his/her failure to provide his/her correct contact information, (b) does not attend the Special Event, or (c) fails to comply with these Terms and Conditions or the terms and conditions in the notice, the Special Event may be forfeited by HKITP.
  13. Neither HKITP nor any of its affiliates shall be responsible for any failure to notify any Participants, whether such failure is caused by HKITP's or any of its affiliates' negligence or otherwise.
  14. Except as otherwise specifically amended by these Terms and Conditions, participation in the Special Event shall be governed by the Terms of Use applicable to the Site.
  15. A Registrant who has registered for a particular Preview Session and subsequently wishes to change for a different date must cancel the original registration first and re-register for the new Preview Session. Once the registration is cancelled, it cannot be retrieved or resumed.
    Event Admission
  16. Participants are required to present a designated Admission Pass issued by HKITP ("Admission Pass") for admission to the Preview Session, which may be redeemed by the Participant in person by presenting their valid Magic Access Membership Cards and such personal identification as HKITP may require at designated ticket booths located at the main entrance of the Park. Admission Pass may only be redeemed on the day of the Preview Session and allow Participants to admit to the Preview Session once only. Cast Member will collect the Admission Pass upon the Participant's admission to the Preview Session. HKITP may refuse admission to the Preview Session if the Admission Pass cannot be presented.
  17. The Registrant must accompany his/her Guest at the time of redemption of the Admission Pass, admission to the Park and at all times throughout the Preview Session.
  18. The Admission Passes are not for sale, are non-transferable, non-refundable, non-exchangeable either in whole or in part, for cash, or any other items.
    Other Terms
  19. Admission to the Park is subject to the Rules and Regulations of the Park which are set out in the website at www.hongkongdisneyland.com. HKITP may from time to time, without prior notice and without refund or compensation, change the operating hours of the Park or attractions, close the Park or any part of it temporarily, restrict the number of persons having access to the Park, and/or suspend or cancel any attraction or entertainment program, due to capacity, inclement weather, special events, to ensure safety, security or order, or if HKITP considers that the circumstances so require. Without limitation to the foregoing, access to attractions is subject to the safety rules of each attraction.
  20. All expenses not specifically provided for in these Terms and Conditions including but not limited to transportation to the Park, admission tickets, food and beverages, gratuities, insurance, parking, room service, merchandise, service charges and telephone calls, are the Participant's sole responsibility.
    Liabilities
  21. Each Participant fully indemnifies HKITP, its affiliates, and the directors, officers or employees of each, against all actions, losses, claims, damages, costs and expenses of whatever nature arising directly or indirectly from any breach of any representation or warranty or any Terms or Conditions contained herein.
  22. To the maximum extent permitted by applicable law, HKITP shall not be liable to any person for any loss or damage (whether caused by the negligence of HKITP or otherwise) or any personal injury or death arising (whether directly or indirectly) from or in connection with the Special Event including, but not limited to, loss of income, profits or goodwill, any loss or damage arising from any failure to receive or process any registration; any computer, telecommunications or equipment failure or malfunction; any deficiency or inadequacy of service rendered by any third party; or any notice which is misdirected or lost in the postal system even if HKITP has been advised of the possibility of such loss or damage.
    Miscellaneous
  23. By submitting or agreeing to the submission of a registration for the Special Event, each Registrant represents that he/she has read and understood and agrees to comply with, and procure his/her Guests to comply with, these Terms and Conditions.
  24. HKITP reserves the right to disqualify any registration or any Participant or his/her participation in the Special Event if HKITP has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
  25. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China ("HKSAR").
  26. The Special Event is organized in accordance with the laws of the HKSAR only. Those who choose to participate in the Special Event do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.
  27. In the event of any dispute regarding these Terms and Conditions and all other matters relating to a Registration or the Special Event, the decision of HKITP shall be final. HKITP's interpretation of these Terms and Conditions shall be final and conclusive.
  28. In the event any conflict arises between the English version and any version in any other language into which these Terms and Conditions have been translated, the English language version shall prevail.
  29. These Terms and Conditions constitute an agreement between HKITP and each Participant respectively. A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce any term of this agreement.


Personal Data Collection Statement

All personal data collected in connection with the Special Event may be used for all purposes in connection with the Special Event including, without limitation, the processing of the Participants' enquiries regarding Participants' participation in the Special Event and any arrangement in connection with the Special Event; enforcing the terms of the commercial dealings; sending administrative materials to Participants; our internal business and administrative purposes, research and statistical purposes or other directly related purpose, or for legal, safety or security purposes. Provision of personal data for the mandatory fields is necessary. If a Participant does not provide such personal data, we may not be able to provide Participant with the products or services requested. Personal data may be transferred to third parties involved in fulfilling the aforesaid purposes, or such other persons as required by law. A list of classes of persons to whom such personal data may be transferred can be found at https://www.hongkongdisneyland.com/privacy-legal/. By participating in the Special Event, each Participant consents to the use and transfer of Participant's personal data set out in this statement.
