Halloween Video – Hong Kong Disneyland Park Tickets Giveaway - Terms and Conditions

Halloween Video – Hong Kong Disneyland Park Tickets Giveaway (the “Activity”) is available from October 5, 2022 (15:00 Hong Kong time) to October 10, 2022 (23:59 Hong Kong time) (the “Activity Period”). Hongkong International Theme Parks Limited ('HKITP') is the organizer of the Activity.
To participate in the Activity, a participant must be a Hong Kong resident aged 13 or above who holds a valid Hong Kong identity card (the “Participant”).
By participating in the Activity, Participant confirms that he/she has read and agrees to these Terms and Conditions and the Personal Information Collection Statement set out herein.
To participate in the Activity, Participant must complete the following steps in response to the Activity’s post (the “Activity Post”) on the Hong Kong Disneyland Facebook page at https://www.facebook.com/disneyland.hk (the “HKDL Facebook Page”) during the Activity Period:
1. “Like” the HKDL Facebook Page and the Activity Post; and
2. Vote for the artist from the Halloween Video which you consider has the most villainous style after watching the video and share the reason(s) for your choice in the comment box of the Activity Post.
HKITP will select, in its sole and absolute judgment and discretion, a total of 10 Participants with the most wickedly creative reasons as winners (the “Winners” and each a “Winner”).
By making submission (including without limitation, images) (collectively, “Materials”) to participate in the Activity, each Participant understands and agrees that HKITP and/or its affiliates may use, reproduce and retain any and all Materials for any purpose and in any manner, medium and format without incurring any liability to the Participant and/or any other person (including the requirement to pay any compensation in respect of such use of Materials). Each Participant further agrees to waive, unconditionally, irrevocably, and without further payment, all moral rights and author’s rights of a similar kind in relation to Materials.
The list of Winners will be announced on the HKDL Facebook Page on October 12, 2022.
Each Winner will be awarded two (2) dates ranged 1-Day General Admission to Hong Kong Disneyland Park Tickets (the “Park Tickets” or “Prizes”). HKITP may in its sole and absolute discretion determine the types, validity and applicable terms and conditions of the Prizes.
Issue and use of Park Tickets and admission to the Hong Kong Disneyland Park (the “Park”) and use of the facilities there are each subject to (i) these terms and conditions; (ii) the “General Terms and Conditions” available at www.hongkongdisneyland.com/ticket-general-terms-conditions/; (iii) the rules and regulations applicable to the location or facility in question (including without limitation, the Rules and Regulations of the Park) set out on www.hongkongdisneyland.com; (iv) the latest requirements at https://www.hongkongdisneyland.com/guest-services/health-and-safety/; and (v) all other requirements, restrictions and changes determined by HKITP in its sole discretion without advance or further notice. HKITP may from time to time, without prior notice and without refund or compensation, (a) make or modify the rules to be followed within the whole or any part of the Park, (b) change or adjust the entry requirement or the mode of operation (including but not limited to operating hours) of the Park or any location, attraction, shop, restaurant, facility or amenity thereat, (c) close or adjust the operation for any period the Park or any part of it, (d) restrict the number, class or eligibility of persons having access to the Park or any part of it, (e) suspend or cancel any attraction, facility, amenity or entertainment or marketing program, offering or activity, and/or (f) impose limit on the purchase of any product or use of any service or facility, in each case due to capacity, inclement weather or special events, to ensure safety, health, security or order, or compliance with law, or if HKITP considers that the circumstances so require.
Each Facebook account is only entitled to one entry to the Activity. Participants with duplicate entries will be disqualified and all his/her entries will be void.
Winners will be notified individually via Facebook Messenger on or after October 12, 2022.
The Winners’ Facebook ID will be used as the final identification of the Winners. The Winners’ Facebook profile name will not be used.
The Winners are required to provide their contact information by sending direct message via Facebook Messenger to the official HKDL Facebook Page before October 14, 2022 (23:59 Hong Kong time), including his/her name, mobile phone number and mailing address within Hong Kong.
Prizes will be sent to the mailing address within Hong Kong provided by the Winners via post. No Prize will be sent to any address outside of Hong Kong. If any Winner fails to provide his/her correct contact information, his/her Prize will be forfeited. HKITP does not guarantee successful or timely delivery of the Prizes.
Prizes are not for sale and may not be substituted or redeemed (in whole or in part) for cash or any other item. HKITP reserves the right to award, in HKITP's sole and absolute discretion, a substitute prize (or portion thereof) of an equal or greater value for whatever reason, including, without limitation, unavailability of the Prizes.
HKITP reserves the right to disqualify any Participant found or suspected of using or posting materials that are inappropriate, offensive, or infringe the rights of any person, taking part in the Activity using Facebook accounts registered with a false identity or attempting to use any program to influence the Activity process or results. HKITP also reserves the right to recover damages or other compensation from such person, and to delete or hide comments involving obscene, indecent language, illegal, intimidating, vulgar, defamatory, infringing privacy, infringing copyrights or promotional rights or vulgarity provided by Participants without prior notice.
The Activity is in no way sponsored, endorsed or administered by, or associated with Facebook. Participants understand that they are providing information to HKITP and not to Facebook.
HKITP reserves the right to exclude any person in any of the following categories to participate in the Activity and/or to be awarded any Prize: (a) persons who are the directors, officers or employees of HKITP or any affiliate, persons who are engaged in the administration, development, production or distribution of the Activity, and persons who are directors, officers or employees of any advertising or promotion agency associated with the Activity; (b) persons who were or are on-site directors, officers or employees of any third party operator at the Hong Kong Disneyland Resort; and (c) persons who are family members (including spouse, or biological, adoptive or step-mother, father, sister, brother, daughter, son or any dependent under any applicable income tax law) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household, whether an immediate family member or not, as any person in any of the preceding categories.
To the maximum extent permitted by law, neither HKITP nor any entity which is controlled by, which controls, or which is under common control with HKITP (collectively “affiliates”), neither HKITP nor any affiliate shall be liable to any person for any loss or damage (whether caused by the negligence of HKITP or any affiliate or otherwise) or any personal injury or death arising (whether directly or indirectly) from or in connection with the Activity or any Prize including, but not limited to, loss of income, profits or goodwill, any loss or damage arising from any failure to receive or process any entry; any error in computing any chance; any computer, telecommunications or equipment failure or malfunction; any deficiency or inadequacy of service rendered by any third party; or any notice which is misdirected or lost in the postal system even if HKITP or any affiliate has been advised of the possibility of such loss or damage.
Neither HKITP nor any affiliate shall be responsible for any failure to notify any Winner, whether such failure is caused by HKITP's or any affiliate's negligence or otherwise or by any human error.
The Activity is offered in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China ('HKSAR') only. Neither HKITP nor any affiliate makes any representation that participation in the Activity is appropriate or available in other locations and the Activity is void in any jurisdiction where participation in such activity is prohibited or restricted by law. Those who choose to participate in the Activity do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.
These Terms and Conditions are subject to the interpretation of HKITP which shall be final and conclusive. In the event of disputes, HKITP reserves the right to make final judgment on the dispute and otherwise in respect of the Activity.
In the event of any conflict or inconsistency between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the HKSAR.
These Terms and Conditions constitute an agreement between HKITP and each Participant respectively. A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce any term of this agreement.

Personal Information Collection Statement
Data collected in connection with this Activity (including your personal data) may be used for the processing of requests or enquiries, enforcing the terms of the commercial dealings, our internal business and administrative purposes or other directly related purpose, or for legal, safety or security purposes. Provision of personal data is necessary. If you do not provide such data, we may not be able to provide you with the products or services you requested. Such data may be transferred to third parties involved in fulfilling the aforesaid purposes, or such other persons as required by law. A list of classes of persons to whom such data may be transferred can be found at https://www.hongkongdisneyland.com/privacy-legal/. You may request access to, and request the correction of, your personal data held by us.
