Magic Access Limited-Time Offer – Terms and Conditions

Hong Kong residents with the following identity proof are eligible for this offer:
1. for full-time students aged 12 to 25, a valid Hong Kong Identity Card and a recent school handbook or full-time student card with photo identification issued by a school located in Hong Kong;
2. for guests aged 3-11, a valid Hong Kong birth certificate and a recent school handbook with photo identification issued by a school located in Hong Kong;
3. for other guests, a valid Hong Kong Identity Card
(each an “Eligible Guest”).
This offer is applicable to the following transactions (each an “Eligible Transaction”) from September 22, 2022 to November 16, 2022 (“Offer Period”):
1. purchase of Adult, Student or Child Silver, Gold or Platinum Magic Access Membership Card(s); and
2. upgrade of Hong Kong Disneyland Park (the “Park”) admission tickets (each an “Admission Ticket”) to Adult, Student or Child Silver, Gold or Platinum Magic Access Membership Cards by paying the applicable price difference determined in accordance with paragraph 7 below.
This offer is available for purchase through the following sales channels during the Offer Period:
1. on www.hongkongdisneyland.com (“Website”) from 11:00am (Hong Kong time) on September 22, 2022 to 6:00pm (Hong Kong time) on November 16, 2022, and;
2. the ticket booths located at the Main Entrance of the Park and Magic Access Member Service Center in the Park (each a “Specified Location”) during the operating hours of these Specified Locations.
When completing an Eligible Transaction, Eligible Guests will be required to provide his/her name, credit card information and other forms of personal data as Hongkong International Theme Parks Limited (“HKITP”) may require.
Eligible Guests who have completed an Eligible Transaction on the Website will receive a confirmation email issued by HKITP (“Confirmation”). All Eligible Guest(s) named in the Confirmation must bring his/her valid personal photo identification mentioned in paragraph 1 above to collect their personalised Magic Access Membership Card(s) on or before November 16, 2022 at the same time in person at the Specified Location during the Park’s operating hours. No Membership Card will be issued if one or more Eligible Guest(s) is/are not present at the same time at the Specified Location.
This offer is not applicable to purchase of Magic Access Certificates, upgrade or renewal of existing Magic Access Membership Cards or any transaction other than those designated in paragraph 2 above.
The price difference applicable to the upgrade of Admission Tickets under paragraph 2(b) above is determined with reference to the purchase price of the Admission Ticket and the prevailing price of the Magic Access selected. The prevailing prices of Magic Access is published on the Website and determined at the time of payment. HKITP reserves the right to determine or change the prevailing price of and benefits associated with the Magic Access at any time and from time to time in its sole and absolute discretion.
Magic Access purchased under this offer which is not redeemed on or before November 16, 2022 during the Park’s operating hours will be void without refund or compensation.
Admission Tickets may be upgraded to Magic Access Membership Cards on the day of visit using the Admission Ticket only. Any Magic Access Membership Cards issued upon upgrade will be valid for one year starting from the date of Eligible Guest’s first Park visit with the original Admission Ticket . No upgrade will be made after the day when the original Admission Ticket is used.
If the selected Magic Access Membership Card is priced lower than the Admission Ticket to be upgraded, no refund will be made.
Upgrade of Admission Tickets is subject to the terms and conditions applicable to the Admission Tickets. Upgrade will not be allowed in the Admission Ticket is specified as non-upgradable, or if its applicable terms and conditions are not complied with.
No exchange or refund will be made for Magic Access which are purchased or issued under this offer or otherwise.
All guests are required to make reservation with valid tickets or membership cards before visiting the Park. Park visit reservation of each type of ticket or membership card is subject to a limited quota. Reservation will not be accepted once the respective quota is full.
As required by law, except exempted persons, all guests shall use the “LeaveHomeSafe” app and fulfill the “Vaccine Pass” vaccination requirement upon entering designated premises including the Park and restaurants for dine-in. Guests with a “Red Code” or an “Amber Code” are not allowed to enter the aforesaid designated premises. HKITP reserves the right to (i) amend or supplement these terms and conditions; (ii) change the prices and validity for any tickets, tours, offers, promotions; (iii) designate or change any block-out dates and (iv) terminate or suspend the availability of any offer, discount or promotion, in each case, at any time and from time to time without prior notice.

General Terms and Conditions applicable to this offer

The issuance and use of Magic Access Membership Card and its benefits and admission to the Park or other parts of Hong Kong Disneyland Resort (“Resort”) there are each subject to (i) the “Magic Access Terms and Conditions” and “Magic Access Benefits Terms and Conditions” which are set out on the www.hongkongdisneyland.com/magic-access-members/ (“Member Site”), the General Terms and Conditions at www.hongkongdisneyland.com/ticket-general-terms-conditions/, the “Offer Highlight” and “Important Details” set out in all relevant pages on the Website, (ii) the rules and regulations applicable to the location or facility in question (including without limitation, the Rules and Regulations of the Park and Hotels) which are set out on the Website, (iii) the latest requirements at https://www.hongkongdisneyland.com/guest-services/health-and-safety/, and (iv) all other requirements, restrictions and changes determined by HKITP in its sole discretion without advance or further notice. HKITP may from time to time, without prior notice and without refund or compensation, (a) make or modify the rules to be followed within the whole or any part of the Resort, (b) change or adjust the entry requirement or the mode of operation (including but not limited to operating hours) of the Resort or any hotel, location, attraction, shop, restaurant, facility or amenity thereat, (c) close or adjust the operation for any period the Resort or any part of it, (d) modify, relocate, refurbish or replace any location, attraction, shop, restaurant, facility or amenity; (e) restrict the number, class or eligibility of persons having access to the Resort or any part of it, (f) suspend or cancel any attraction, facility, amenity or entertainment or marketing program, offering or activity, and/or (g) impose limit on the purchase of any product or use of any service or facility, in each case due to capacity, inclement weather or special events, to ensure safety, health, security or order, or compliance with law, or if HKITP considers that the circumstances so require.
This offer cannot be used in conjunction with any other offer, promotion, discount or benefit (including without limitation any Cast Member discount).
Except as supplemented by the Personal Information Collection Statement provided during the Eligible Transaction, personal data collected upon the purchase or issue of Magic Access will be held, processed and used in accordance with the applicable privacy policy set out in the Website. Copies of HKITP’s privacy policy are also available upon request at any of HKITP’s ticket sales locations.
This offer is made in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“HKSAR”) only. This offer may only be redeemed in the HKSAR in accordance with these Terms and Conditions. HKITP makes no representation that participation in this offer is appropriate or available in other locations and this offer is void in any jurisdiction where participation in such an offer is prohibited or restricted by law. Those who choose to participate in this offer do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.
These Terms and Conditions are subject to the interpretation of HKITP which shall be final and conclusive.
In the event of disputes, HKITP reserves the right to make final judgment on the dispute and otherwise in respect of this offer.
In the event of any conflict or inconsistency between the English version and other language version of these Terms and Conditions, the English version shall prevail.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the HKSAR.
These Terms and Conditions constitute an agreement between HKITP and the person making the purchase with HKITP in the designated sales location(s) (including the Member Site). A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce any term of this agreement.

Personal Information Collection Statement
Data collected in connection with this Activity (including your personal data) may be used for the processing of requests or enquiries, enforcing the terms of the commercial dealings, our internal business and administrative purposes or other directly related purpose, or for legal, safety or security purposes. Provision of personal data is necessary. If you do not provide such data, we may not be able to provide you with the products or services you requested. Such data may be transferred to third parties involved in fulfilling the aforesaid purposes, or such other persons as required by law. You may request access to, and request the correction of, your personal data held by us.
