World of Frozen “Let It Go Like Never Before” Campaign - Terms and Conditions

1. World of Frozen “Let It Go Like Never Before” Campaign (the “Activity”) is available from October 13, 2023 (12:00 Hong Kong time) to February 28, 2024 (23:59 Hong Kong time) (“Activity Period”). Hongkong International Theme Parks Limited (“HKITP”) is the organizer of the Activity.

2. To participate in the Activity, participants must be aged 18or above (the “Participants” and each a “Participant”).

3. By participating in the Activity through posting photos or videos with the hashtag #WorldOfFrozen and #LetItGo and @HKDisneyland on Facebook and/or Instagram, each Participant confirms that he/she has read and agreed to these Terms and Conditions and the Personal Information Collection Statement set out herein. By making any submission (including without limitation, images) (collectively, “Materials”) to participate in the Activity, each Participant understands and agrees that HKITP and/or its affiliates may use, reproduce and retain any and all Materials for any purpose and in any manner, medium and format without incurring any liability to the Participants and/or any other person (including the requirement to pay any compensation in respect of such use of Materials). Each Participant further agrees to waive, unconditionally, irrevocably, and without further payment, all moral rights and author’s rights of a similar kind in relation to Materials.

4. Subject to these Terms and Conditions, each Participant must complete the following steps to participate in the Activity:

a. Within the Activity Period, share photo(s) or video(s) taken: (1) in the World of Frozen at Hong Kong Disneyland Park; or (2) with any World of Frozen related official promotional materials, characters or merchandise items, with the hashtag #WorldOfFrozen and #LetItGo and tag @HKDisneyland on the Participant’s own Facebook and/or Instagram account(s).

b. Each Participant sets his/her Facebook/Instagram account as a “public” account;

5. One or more photo(s) or video(s) submitted by the Participant may qualify for selection for reposting on Facebook and/or Instagram page(s) of Hong Kong Disneyland (“HKDL”) and HKITP reserves the right of final decision and judgment in this regard. Users cannot use music. Any entries including music are ineligible and will not be considered.

6. The Participant’s Facebook ID or Instagram username will be used as the final identification of the Participant. The Participant’s Facebook or Instagram profile name will not be used.

7. HKITP reserves the right to disqualify any Participant found or suspected of using or posting materials that are inappropriate, offensive, or infringes the rights of any person, taking part in the Activity using accounts registered with a false identity or attempting to use any program to influence the Activity process or results. HKITP also reserves the right to recover damages or other compensation from such person, and to delete or hide comments with elements of indecent, illegal, intimidating, infringing, and or obscene language provided by Participants without prior notice.

8. The Activity is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. Participants understand that they are providing information to HKITP, and not to Facebook nor Instagram.

9. To the maximum extent permitted by law, neither HKITP nor any entity which is controlled by, which controls, or which is under common control with HKITP (collectively “affiliates”) shall be liable to any person for any loss or damage (whether caused by the negligence of HKITP or any affiliate or otherwise) or any personal injury or death arising (whether directly or indirectly) from or in connection with the Activity including, but not limited to, loss of income, profits or goodwill, any loss or damage arising from any failure to receive or process any entry; any error in computing any chance; any computer, telecommunications or equipment failure or malfunction; or any deficiency or inadequacy of service rendered by any third party; even if HKITP or any affiliate has been advised of the possibility of such loss or damage.

10. The Activity is offered in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China (”HKSAR”) only. Neither HKITP nor any affiliate makes any representation that participation in the Activity is appropriate or available in other locations and the Activity is void in any jurisdiction where participation in such activity is prohibited or restricted by law. Those who choose to participate in the Activity do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.

11. These terms and conditions are subject to the interpretation of HKITP which shall be final and conclusive. In the event of disputes, HKITP reserves the right to make final judgment on the dispute and otherwise in respect of the Activity.

12. In the event of any conflict or inconsistency between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.

13. These Terms and Conditions shall be governed by and construed in accordance with the laws of the HKSAR.

14. These Terms and Conditions constitute an agreement between HKITP and each Participant respectively. A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce any term of this agreement.

Personal Information Collection Statement

Data collected in connection with this Activity (including your personal data) may be used for the processing of requests or enquiries, enforcing the terms of the commercial dealings, our internal business and administrative purposes or other directly related purpose, or for legal, safety or security purposes. Provision of personal data is necessary. If you do not provide such data, we may not be able to provide you with the products or services you requested. Such data may be transferred to third parties involved in fulfilling the aforesaid purposes, or such other persons as required by law. A list of classes of persons to whom such data may be transferred can be found at https://www.hongkongdisneyland.com/privacy-legal/. You may request access to, and request the correction of, your personal data held by us.
